TERMS AND CONDITIONS
1. The terms and conditions set out below apply to all deliveries, services and offers concluded with us. Any supplementary agreements must be confirmed by us in writing. We reserve the right to add to or change these terms and conditions at any time giving an appropriate period of notice.
2. Offers by the vendor are subject to change and non-binding. Catalogues, samples and descriptions are provided for general guidance only. All information contained therein, unless expressly marked otherwise, should be considered as approximate and in no way guaranteed. Delivery times given by the vendor are non-binding. The prices listed in our price list on the day of delivery or shipping are the prices which apply unless we have expressly confirmed otherwise in writing.
3. Complaints can only be taken into consideration when made in writing within 14 days of receipt of the goods. The liability of the vendor for faults in products delivered is limited to the replacement of the product. Further liability for compensation or claims for damages are excluded.
4. All retail prices are inclusive of the statutory VAT in force on the day of delivery and inclusive of packaging.
5. Goods delivered remain the property of VELIND Aerosol GmbH until full payment of the purchase price and until payment of all debts outstanding to us on the part of the purchaser arising from the business relationship.
6. For both contract parties, the place of fulfillment for delivery and payment, and court of jurisdiction for all obligations arising from the business relationship, is the registered office of the company. The law of the Federal Republic of Germany applies exclusively in all cases.
VELIND Aerosol does not accept liability for failure of delivery or for late delivery if these are caused by force majeure or other events which could not have been foreseen at the time that the contract was concluded and which are beyond the responsibility of the company.
7. Agreements which differ from our terms and conditions apply only if recognized by us in writing. For any points not covered in these "Terms and Conditions", the applicable commercial law applies.
